Telephone Consumer Protection Act Violations Alleged in Class Action Against United Card Solutions LLC
On February 21, 2018, a class action complaint was filed against United Card Solutions LLC in United States District Court, Central District of California, by Terry Fabricant individually and on behalf of all persons to whom United Card Solutions, and/or a third party acting on United Card Solutions’s behalf, made one or more non-emergency telephone calls promoting the company’s goods or services to cellular telephone numbers through the use of an automatic telephone dialing system or an artificial or prerecorded voice within the past four years.
According to the class action complaint, United Card Solutions employed telemarketing to markets its payment services and generate new customers through the use of an automatic telephone dialing system to solicit business.
The Plaintiff, allegedly, has never been a customer of United Card Solutions and never provided prior express written consent to receive automatic telephone dialing system-generated or prerecorded calls from, or on behalf of, United Card Solutions. United Card Solutions, allegedly, placed unsolicited, prerecorded sales calls to the Plaintiff’s cell phone in October and November 2017 without the Plaintiff’s prior express consent to make such automated calls. When contacted in October 2017, the Plaintiff’s caller ID displayed (215) 595-9072.
Among other relief, the class action seeks, as a result of the alleged Telephone Consumer Protection Act (“TCPA”) violations committed by United Card Solutions, its affiliates or agents acting on its behalf, statutory damages of $500 for each and every automated call made to the cell phones of Plaintiff and the other Class members, as well as treble, or triple, statutory damages of up to $1,500 for each and every call made knowingly or willfully in violation of the TCPA.
