Kehoe Law Firm, P.C. is making consumers aware that on February 12, 2019, a class action lawsuit was filed against Select Home Warranty LLC in United States District Court for the District of Arizona under the Telephone Consumer Protection Act for ” . . . routinely violat[ing] 47 U.S.C. § 227(b)(1)(A)(iii) by using an automatic telephone dialing system . . . to place calls, and by delivering artificial or prerecorded voice messages, to telephone numbers assigned to a cellular telephone service, without prior express consent, in that it (a) continues placing calls after being instructed to stop calling and (b) places calls in an effort to solicit new business after consumers’ service contracts expire.”
According to the class action complaint, Select Home Warranty placed calls to “Plaintiff’s cellular telephone from (317) 754-6649 and (855) 267-3532 – telephone numbers assigned to Defendant.” Despite the expiration of Plaintiff’s policy term in October 2018 and the Plaintiff’s instruction not to call his cell phone, Select Home Warranty, allegedly, “continued placing calls to Plaintiff’s cellular telephone number” in October, November, and December, 2018, as well as in January and February, 2019. Allegedly, Select Home Warranty “left a host of prerecorded voice messages on Plaintiff’s cellular telephone.”
